Terms and Conditions

1. Definitions

1.1 In these terms and conditions:

“Written Quotation” means the written quotation from MHC to the Customer attached to these terms and conditions;

“Price” means the price referred to in the Written Quotation;

“Contract” means the contract for the supply and installation of the Goods between the Customer and the Company incorporating the Written Quotation and these terms and conditions;

“Customer” means the person who accepts MHC’s Written Quotation for the sale of Goods;

“Acceptance” means the acceptance of the Contract by the Customer paying the deposit;

“Goods” means the goods (including any instalment of the goods or any parts for them) which MHC are to supply in accordance with the Written Quotation;

“Labour” means the provision of labour to install the Goods as may be required.

2. Things you should know

2.1 Our survey is not a structural or building survey and if the work cannot be completed, or any damage is caused through existing structural or other defects in your property, (which may not be evident at the time of our survey) we cannot be responsible for this.

2.2 Whilst we take all reasonable care to avoid damage to masonry, concrete, rendered, tiled surfaces etc we cannot take responsibility for any cracking, spalling etc. We do not undertake to provide matching specialised finishes (e.g. pebble dash) or ceramic or other tiles. In particular, any drilling of tiled surfaces is entirely at your own risk.

2.3 Security products are supplied on the basis that they will provide a deterrent effect against unauthorised entry. We do not give a warranty or guarantee that any such product will prevent such entry.

3. Terms of Payment

3.1 The Customer will pay 50% of the Price upon Acceptance as a non refundable down payment. The balance of the Price is to be paid on the day of completion of the work by MHC.

4. Cancellation

4.1 We reserve the right to cancel (and return your deposit) in the following cases:

4.1.1 Where, after a survey has been carried out, it is apparent that the work as shown in our quotation cannot be carried out for safety or other technical reasons.

4.1.2 Where, after surveying we find it necessary to recommend design changes which you do not want to agree to, either because they will cost more, or for any other reason.

5. Warranties and Liability

5.1 MHC warrants that the Goods will correspond with their specification at the time of delivery and will be free from defects in material and workmanship.
BFT Equipment will be guaranteed for 2 years (Manufacturer’s warranty) Videx GSM Intercom and Daitem Intercom for 1 Year ( Manufacturer’s warranty) . Labour at our normal hourly rate plus vat.

5.2 The above Warranty is given by MHC subject to the following conditions:

5.2.1 MHC shall be under no liability in respect of any defect in the Goods arising from any drawing, design or specification supplied by the Customer;

5.2.2 MHC shall be under no liability in respect of any defect arising from fair wear and tear, wilful damage, negligence, abnormal working conditions, misuse or alteration or repair of the Goods without MHC’s approval;

5.2.3 MHC shall be under no liability under the above warranty (or any other warranty, condition, or guarantee) if the total price for the Goods has not been paid upon the due date for payment.

5.3 MHC warrants that Labour will be provided with all reasonable care and skill.

5.4 Subject as expressly provided for in these terms and conditions, and except where these Goods are sold to a person dealing as a consumer (within the meaning of the Unfair Contract Terms Act 1977), all warranties, conditions or other terms implied by statute or common law are excluded to the fullest extent permitted by law.

5.5 Except in respect of death or personal injury caused by MHC’s negligence, or liability for defective products under the Consumer Protection Act 1987, MHC shall not be liable to the Customer by reason of any representation (unless fraudulent), or any implied warranty, condition or any other term, or any duty at common law, or under the express terms of the contract, for loss of profit or any indirect, special or consequential loss or damage, costs, expenses or other claims for compensation whatsoever (whether caused by the negligence of MHC its employees or agents or otherwise) which arise out of or in connection with the supply of the Goods (including any delay in supplying or any failure to supply the Goods in accordance with the contract or at all) or their use or resale by the Customer, and the entire liability of MHC under or in connection with the contract shall not exceed the price of the Goods, except as expressly provided in these terms and conditions.

5.6 A claim by the Customer which is based on any defect in the quality or condition of the Goods or their failure to correspond with specification shall be notified to MHC within five days from the date of delivery or within a reasonable time after the discovery of the defect or failure. In the event that the Customer fails to notify MHC in accordance with this term, the Customer shall not be entitled to reject the Goods and MHC shall have no liability for such defect or failure, and the Customer shall be bound to pay the Price as if the goods had been installed in accordance with the contract.

5.7 MHC shall not be liable to the Customer or deemed to be in breach of the contract by reason of any delay in performing, or any failure to perform, any of MHC’s obligations in relation to the Goods, if the delay or failure was due to any cause beyond MHC’s reasonable control.

6. Your responsibility

6.1 You will obtain all permissions and consents (including, if necessary, planning permission) from landlords, local authorities and so on, which may be required before the job can be carried out.

7. Installation of Goods

7.1 The Customer is responsible for ensuring that any installation of Goods can be carried out by MHC, its employees or agents without risk of causing damage to any mains services (electricity, water, gas or telecommunications). Any mains services that may run under the ground where the installation of goods is to take place must be brought to the attention of MHC.


8. Ownership and risk

8.1 Goods remain the property of MHC until paid for in full and in entering this contract you give us the right to remove said goods if payment isn’t received in full and to enter any premises on which they are installed, left or kept. We will in the event of such repossession take reasonable steps to leave any site of installation safe, and to cause as little damage as possible.

9. General

9.1 The contract between MHC and the Customer shall be governed by the laws of England, and MHC and the Customer agrees to submit to the non-exclusive jurisdiction of the English courts.
